Drugs Appeal Success

When represented by other counsel at the Crown Court at Liverpool, Ruben Carroll was sentenced to 15 years' imprisonment by HHJ Trevor-Jones for three separated drugs conspiracies. Nigel Power QC was instructed on a privately-paid basis to appear on the appeal. A successful argument was made to the effect that:

(a) There was not enough credit given for the guilty pleas; and

(b) The overall sentence was too long because the Judge had not had sufficient regard to totality.

The Judges (Lord Justice Davis, Mr Justice Stewart and Mr Justice Lewis) reduced the overall sentence by 3 years, from 15 years to 12 years' imprisonment.

In this case Nigel was instructed by Mark Davies of Frisby's Solicitors.
